Introduction: Market access is the starting point for all economic entities to conduct operations and participate in competition. On May 8, Vice Chairman Zheng Baizhong of the National Development and Reform Commission stated at a press conference that the Private Economy Promotion Law fully embodies the principles of equal treatment, fair competition, equal protection, and common development. The Development Commission will focus on advancing implementation through three key areas: breaking down barriers, expanding space, and improving services.

The private economy promotion law holds major significance and far-reaching impact
"The release of the Private Economy Promotion Law is a significant measure in implementing the spirit of President Xi's important speech. This law is of great importance and has profound influence on promoting high-quality development of the private economy," said Zheng Baizhong at the press conference.
First, it further stabilizes expectations. The Private Economy Promotion Law clearly emphasizes strengthening support for sustained, healthy, and high-quality development of the private economy—a long-term national policy direction. It explicitly strengthens the principles of equal treatment, fair competition, equal protection, and common development, fully demonstrating the Party and state's clear stance and firm resolve to promote private economic growth. By providing legal certainty, it enhances the stability of development and serves as a 'confidence anchor' for private enterprises to operate with peace of mind and grow steadily.
Second, it further builds confidence. The Private Economy Promotion Law proactively responds to concerns of private enterprises by introducing targeted institutional arrangements. In terms of fair market participation, the law stipulates a nationwide unified negative list for market access, implements fair competition review mechanisms, and safeguards the principle of 'non-prohibited entry.' Regarding equal access to production factors, the law ensures that private economic organizations can legally and equally access capital, technology, human resources, data, land, and public service resources, achieving 'one view for all.' In terms of equal legal protection, the law guarantees the personal rights, property rights, and legitimate business autonomy of private enterprises and their operators, emphasizing 'no infringement.'
Third, it further promotes high-quality development. The Private Economy Promotion Law establishes a solid legal foundation for today’s needs and future vision, offering strong legal support for high-quality private economic growth. On one hand, it focuses on incentive support. Special chapters on 'investment and financing promotion' and 'technological innovation' are set up to encourage private enterprises to participate in major national strategies and key projects—investing in strategic emerging industries, future-oriented sectors, and entrepreneurship. These measures actively play roles in driving technological innovation, cultivating new productivity, and building modern industrial systems. On the other hand, it emphasizes guidance and standardization. It encourages private enterprises to improve governance structures and management systems, comply with laws and regulations, strengthen risk prevention, fulfill social responsibilities, and promote healthy development and sustainable growth of private enterprises and talent.
"We believe that the introduction of this law will surely inspire broad private enterprises and entrepreneurs to be bold and proactive, making greater contributions to advancing China-style modernization," said Zheng Baizhong.
Market access: Breaking down barriers, expanding space, improving services
"During our research and communication with private enterprises, we have learned that they are highly concerned about market access issues," said Zheng Baizhong. The Private Economy Promotion Law comprehensively reflects the principles of equal treatment, fair competition, equal protection, and common development—not only at the general level but also specifically embodied in chapters on fair competition, investment and financing promotion, technological innovation, and legal responsibility. To implement the law effectively, the National Development and Reform Commission will work with relevant departments to intensify efforts in three areas: breaking down barriers, expanding space, and improving services:
Breaking down access barriers. Recently, the National Development and Reform Commission jointly with relevant ministries released a new version of the market access negative list, further streamlining it. We are conducting comprehensive clean-up actions on market access barriers, transitioning from temporary campaigns to normalized enforcement within half a year. We are actively promoting public participation in tenders and bidding, leading to a 5 percentage point increase in private enterprise bid success rates from January to April this year. For projects under 10 million yuan, the proportion of private enterprises participating exceeds 80%.
Expanding development space. We support private enterprises in actively participating in the construction of the 'two major' initiatives and the 'two new' works, accelerating the establishment of long-term mechanisms for private sector involvement in national major projects. So far, a series of major projects have been launched in nuclear power, railways, and other fields. Currently, the private equity ratio in existing nuclear power projects has reached 20%. In industrial equipment upgrading, circular economy utilization, and related fields, private enterprise funding accounts for over 80%. This year, we will launch high-quality projects worth approximately 300 million yuan in key areas such as transportation and logistics, energy, water conservancy, new infrastructure, and urban infrastructure. At the same time, we will strongly support private enterprises in investing in emerging and future industries, taking the lead in tackling national key technological challenges, and equally accessing major national scientific research infrastructure and industrial technology platforms. We will actively participate in the innovation and construction of new technology and product application scenarios.
Optimizing service and protection. The National Development and Reform Commission will continue to strengthen project services, publicly releasing information on major investment projects in the private economy. We will provide standardized, efficient, and convenient services in project presentation, pre-work procedures, and reporting approval processes, helping private enterprises better understand 'where to invest' and 'how to invest.' We will also continue to strengthen essential resource protection, improving mechanisms for land use, environmental evaluation, and financial security. We will optimize incentive measures for attracting and cultivating high-level talents, supporting private enterprises in participating in data element market construction and standards formulation, enhancing intellectual property protection, improving the social credit system, refining dispute resolution mechanisms, and empowering private enterprises with more innovation vitality.
Key achievements will become even more prominent across five areas
"The vitality of the law lies in its implementation. Private enterprises are fully confident in the effective enforcement of this law," said Zheng Baizhong. The National Development and Reform Commission will actively fulfill its coordination functions, working closely with various ministries and local governments to push forward the implementation of the law, focusing on three critical areas:
First, accelerate institutional setup. During the legislative process, following instructions from the Central Committee and the State Council, the National Development and Reform Commission will work with relevant departments to advance the 'legislative preparation' plan, synchronously planning and launching related regulations. A batch of supporting institutions and mechanisms have already been issued, including the new market access negative list, the payment rules for small and medium-sized enterprises, the fair competition review rules and their implementation guidelines, the concept of a sound social credit system, and the long-term supervision mechanism for enterprise revenue and expenditure. Additional measures are currently being expedited, covering investment and financing promotion, technological innovation, service protection, and rights protection. Meanwhile, many localities are adapting these frameworks to their specific realities and actively improving relevant supporting mechanisms.
Second, ensure tangible results. The National Development and Reform Commission will work with relevant departments to fully promote law implementation, strengthen strict enforcement, and focus on achieving significant progress in five key areas: removing barriers and eliminating obstacles to solve issues in market access and factor acquisition; improving governance and addressing problems related to SME payments; protecting legal rights and resolving post-development concerns; enforcing policies effectively to address weak sense of gain; and enhancing government-enterprise communication to meet reasonable demands.
Third, strengthen learning and publicity. The National Development and Reform Commission will work with various departments and local governments to thoroughly study the content of the law, deeply understand its spirit, and better apply legal thinking and methods to advance private economic work. We will strengthen law dissemination to help private enterprises learn, understand, and use the law effectively, safeguard their legal rights, expand development space, strengthen core competitiveness, and play a prominent role in China-style modernization. We will promote widespread understanding and compliance with the law across society, fostering shared awareness and collective strength to jointly advance the high-quality development of the private economy.
